Do You Need a Fence Permit in Portland? The 2026 Rules in Plain English

Heights, front-yard vs. back-yard rules, property lines, and when you actually need a permit — minus the code-book headache.

The permit question stops a lot of fence projects before they start, usually out of a vague fear of "getting in trouble." The reality in Portland is more relaxed than people expect — but there are a few lines you don't want to cross. Here's the plain-English version. (Always confirm for your exact address; codes change and lots have quirks.)

The Height Rule Is the Big One

In most Portland residential zones, a fence up to about 7 feet in the back and side yards generally doesn't require a building permit. Front yards are stricter — typically capped much lower (often around 3½ feet) so fences don't wall off the street. Go taller than the limits, or build in certain overlay zones, and a permit comes into play.

Property Lines and Corners

Permits aside, the thing that actually causes disputes is the property line. Build on your side of it, and know where it is before you dig — a fence a foot over the line is a legal headache that outlasts the fence. Corner lots have "vision clearance" rules too, so a fence doesn't block sightlines at the intersection.

HOAs Have Their Own Book

If you're in an HOA, the city isn't your only rulebook — your association may dictate height, material, color, and even which way the finished side faces. Check the CC&Rs before you fall in love with a design.
